'Total Miner' Xbox 360 Marketplace

Anyone else noticed this complete rip off of minecraft on the Xbox game marketplace?
I downloaded the trial it is so similiar to Minecraft. Surely they have to get permission for this, seeing as the real Minecraft is coming to Xbox 360 in the future!?
Anyway the game felt pretty bad and costs 240 points. Not as slick as on the PC and crafting ect felt weird.
Anyone else think this is a rip off of the real minecraft?
